{"id":19723,"date":"2024-10-10T10:59:27","date_gmt":"2024-10-10T08:59:27","guid":{"rendered":"https:\/\/www.yqapartments.sk\/privacy-policy\/"},"modified":"2024-11-21T22:57:10","modified_gmt":"2024-11-21T21:57:10","slug":"privacy-policy","status":"publish","type":"page","link":"https:\/\/www.yqapartments.sk\/en\/privacy-policy\/","title":{"rendered":"Privacy Policy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Principles of processing and protection of personal data<\/strong>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The controller of personal data pursuant to Article 4 point 7 of Regulation (EU) 2016\/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data is <strong>Auto Market Experts, s.r.o., Company ID: 36581704, 044 23 Rudn\u00edk No. 41<\/strong>,<strong> Slovakia<\/strong>, registered in the Commercial Register of the Municipal Court of Ko\u0161ice, section: sro, entry number: 15147\/V as the owner of the website YQapartments.sk (hereinafter referred to as: &#8220;Lessor&#8221;).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contact details of the controller are:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">address: Rudn\u00edk 41, 044 23 Jasov\u00a0<br>email: gdpr@yqservice.eu\u00a0<br>telephone: +421 907 955481\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data are all information about an identified or identifiable natural person. An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as a name, identification number, location data, network identifier or one or more specific factors.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An identified or identifiable person for the purposes of these Principles is considered to be the person ordering accommodation services in the administrator&#8217;s accommodation facilities published on the YQapartments.sk website (hereinafter referred as \u201eCustomer\u201c).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. The contracting parties have agreed that the customer, if he is a natural person, is obliged to provide the lessor in the order\/reservation his name and surname, permanent address including zip code, telephone number, e-mail address and a copy of his ID card\/passport.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. The contracting parties have agreed that the customer, if he is a legal entity, is obliged to provide the lesser in the order\/reservation his business name, registered office address including zip code, company ID, name and surname of the contact person, telephone number and e-mail address.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. The lessor hereby informs the customer that pursuant to the provisions of \u00a7 10, paragraph 3, letter b) of Act No. 122\/2013 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the &#8220;Privacy Act&#8221;), the lessor as the operator will process the personal data of the customer in the process of managing the reservation, invoicing and related correspondence without his consent as the data subject, since the processing of the customer&#8217;s personal data will be carried out by the lessor in pre-contractual relations with the customer and the processing of the customer&#8217;s personal data is necessary for the fulfillment of the reservation and the provision of accommodation services, in which the customer acts as one of the contracting parties.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. The customer may express his consent pursuant to the provisions of \u00a7 11 par. 1 of the Act, that the lessor processes and stores his personal data, in particular those listed above and\/or which are necessary for the seller&#8217;s activities related to sending information about new accommodation options, discounts and promotions, and processes them in all of its information systems.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. The lessor undertakes to handle and dispose of the customer&#8217;s personal data in accordance with the applicable legal regulations of the Slovak Republic.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6. The lessor declares that, in accordance with the provisions of \u00a7 6, paragraph 2, letter c) of the Personal Data Protection Act, he will collect personal data exclusively for the purpose specified in these principles.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7. The Lessor declares that, in accordance with the provisions of \u00a7 6, paragraph 2, letter e) of the Personal Data Protection Act, he will collect personal data for purposes other than those specifically stated in these principles and will ensure that personal data is processed and used exclusively in a manner that corresponds to the purpose for which it was collected and that it will not be combined with personal data that was collected for other purposes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8. Before confirming the reservation, the Customer will be asked to confirm by checking the box before sending the reservation that the Lessor has notified him in a sufficient, understandable and unmistakable manner:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) his identification data&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) the purpose of processing personal data, which is to conclude a rental agreement between the lessor and the customer,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) that it will process the customer&#8217;s personal data in the scope of the name and surname, permanent address including zip code, telephone number, e-mail address and copy of the ID card\/passport, if the customer is a natural person and in the scope of the business name, registered office address including zip code, company ID, name and surname of the contact person, telephone number and e-mail address if the customer is a legal entity.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9. The Lessor declares that he will process personal data in accordance with good morals and will act in a manner that does not contradict the Personal Data Protection Act or other generally binding legal regulations and will not circumvent them. The Lessor declares that the consent of the data subject will not be enforced or conditioned by the threat of refusal of the contractual relationship, service, goods or obligation established for the Lessor.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10. The Customer has the right, based on a written request, to require from the Lessor&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) confirmation of whether or not personal data about him\/her are being processed,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) the purpose of processing personal data,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) in a generally understandable form information about the processing of his\/her personal data in the information system and about its status to the extent of:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">i) identification data of the Lessor and the Lessor&#8217;s representative, if appointed,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ii) identification data of the intermediary; this does not apply if the Lessor does not proceed in accordance with Section 8 of the Personal Data Protection Act when obtaining personal data,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) in a generally understandable form, precise information about the source from which he obtained his personal data for processing,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) in a generally understandable form, a copy of his personal data that are the subject of processing,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f) additional information that, taking into account all the circumstances and conditions of the processing of personal data, is necessary for the buyer to guarantee his rights and legally protected interests, in particular&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">i) information on the voluntariness or obligation to provide the requested personal data; if the Lessor obtains the Customer&#8217;s personal data based on the Customer&#8217;s consent pursuant to Section 11 of the Personal Data Protection Act, he shall also notify the Customer of the validity period of the consent, and if the customer&#8217;s obligation to provide personal data results from a directly enforceable legally binding act of the European Union, an international treaty by which the Slovak Republic is bound, or a law, the lessor shall notify the Customer of the legal basis that imposes this obligation on him and shall inform him of the consequences of refusing to provide personal data,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ii) information about third parties, if it is assumed or obvious that personal data will be provided to them,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">iii) the group of recipients, if it is assumed or obvious that personal data will be made available to them,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">iv) the form of publication, if personal data are to be published,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">v) third countries, if it is assumed or obvious that personal data will be transferred to these countries,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">g) correction of his incorrect, incomplete or outdated personal data that are the subject of processing,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">h) destruction of his personal data, if it was the purpose of their processing has been fulfilled; if the subject of processing is official documents containing personal data, he may request their return,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">i) the destruction of his personal data, which are the subject of processing, if there has been a violation of the Personal Data Protection Act or other valid legal regulation of the Slovak Republic.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11. The Customer, based on a free written request, has the right to object to the Lessor against:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) the processing of his personal data, which he assumes are or will be processed for direct marketing purposes without his consent, and to request their disposal,&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) use of personal data specified in \u00a7 10 par. 3 letter d) for the purposes of direct marketing in the mail, or&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) provision of personal data specified in \u00a7 10 par. 3 letter d) for the purposes of direct marketing.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12. The Customer has the right, upon a free written request, to object to the Lessor against the processing of personal data in cases pursuant to Section 10, paragraph 3, letter a a), e), f) or g) of the Personal Data Protection Act by stating justified reasons or by presenting evidence of an unjustified interference with its rights and legally protected interests, which are or may be damaged in a specific case by such processing of personal data; if this is not prevented by legal reasons and it is proven that the Customer&#8217;s objection is justified, the Lessor is obliged to block and destroy the personal data, the processing of which the Customer has objected, without undue delay and as soon as circumstances permit.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13. The Customer, upon written request or in person, if the matter cannot be postponed, also has the right to object to the lessor at any time and not to submit to a decision of the lessor that would have legal effects or a significant impact for him, if such a decision is issued solely on the basis of automated processing of his personal data. The Customer has the right to ask the lessor to review the issued decision by a method different from the automated form of processing, while the lessor is obliged to comply with the customer&#8217;s request, in such a way that the authorized person will have a decisive role in reviewing the decision; the Lessor shall inform the Customer of the method of review and the result of the finding within 30 days of filing the objection. The Customer does not have this right only if it is provided for by a special law in which measures to ensure the legitimate interests of the Customer are regulated, or if within the framework of pre-contractual relations or during the existence of contractual relations, the lessor issued a decision by which he complied with the request of the customer, or if the lessor based on contract took other appropriate measures to ensure the legitimate interests of the Customer.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">14. If the Customer asserts his right in writing and the content of his request shows that he is asserting his right, the request is considered to have been submitted in accordance with this law; the request submitted by e-mail or fax shall be delivered in writing by the Customer no later than three days from the date of its sending.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">15. If the Customer suspects that his personal data is being processed unlawfully, he may file a notification to the Office for Personal Data Protection. If the Customer does not have the capacity to perform legal acts in full, his rights may be exercised by his legal representative.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">16. The Lessor is obliged to process the Customer&#8217;s request in writing, or to comply with the customer&#8217;s requirements pursuant to the Personal Data Protection Act and to inform him in writing no later than 30 days from the receipt of the request or requirement.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">17. The Lessor shall immediately notify the data subject and the Office for Personal Data Protection in writing of any restriction of the customer&#8217;s rights pursuant to Section 28(2) of the Personal Data Protection Act.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The administrator is entitled to modify or amend these Principles. The new version of the Principles for Processing and Protection of Personal Data shall be published on its website.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These Principles come into effect on 01.12.2024&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Principles of processing and protection of personal data&nbsp;
